Best interest of creditors

A principle applicable under the WHOA: creditors may not be worse off under the composition than in bankruptcy. At the request of a dissenting creditor or shareholder, the court can refuse homologation if this creditor or shareholder is worse off under the composition than in bankruptcy. See Article 384(3) of the Faillissementswet (Bankruptcy Act).
