The formal definition in the Netherlands of a contract takeover is the takeover of the legal relationship as laid down in a contract. The takeover has to take place in written.
The other party (of the party who transfers) also has to agree to the takeover. This permission has no prescribed form, however, it is recommended to acquire written permission to avoid evidentiary problem later on.
The takeover of a commercial lease agreement is -under circumstances- provided for in Dutch law. If a business owner sells his business to a third party and his landlord will not voluntarily cooperate to a takeover, he can demand in court that his landlord will agree to the takeover of the lease contract by the new proprietor.
